🔐 Practically Positive Dog Training – Service Contract

By submitting this form, I ("Owner") confirm that I have read, understood, and agree to be legally bound by the following terms in connection with dog training services provided by Practically Positive, LLC.

1. Payment and Fees
I agree to pay in full at the time of service. Fees are based on time spent delivering professional services, not on guaranteed outcomes. Rates may change without notice.

2. Health and Vaccination Requirements
I confirm my dog is current on Rabies, Distemper, and Bordetella vaccines, free of parasites, and not exhibiting illness or injury. I agree not to bring my dog to training if recently exposed to contagious disease without veterinary clearance or 10 days symptom-free.

3. Behavior Disclosure and Risk Acknowledgement
I certify that all behavioral history I provide is accurate. I understand there are inherent risks in animal handling. I accept full financial responsibility for any injuries or damages caused by my dog. I agree not to hold Practically Positive, LLC liable for any injury, loss, or damage—whether caused by my dog, myself, or the trainer, including cases of negligence.

4. Training Outcomes and Refund Policy
I understand no training results are guaranteed, and that success depends on factors including my dog’s temperament, environment, and my own consistency. I acknowledge that no refunds will be issued, as fees are based on time spent and professional services rendered.

5. Liability and Indemnification
I agree to indemnify and hold harmless Practically Positive, LLC, its staff, and affiliates from all claims, including direct and consequential damages, arising from my dog’s behavior or my participation in training.

6. Ownership and Legal Authority
I affirm I am the legal owner or authorized agent of the dog and have authority to enter this agreement.

7. Media Release
I give permission for photos or videos of my dog during training to be used by Practically Positive, LLC for educational or promotional purposes, without compensation.

8. Group Class Policy (if applicable)
I agree to follow all class rules, including:

  • No use of aversive tools (e.g., prong/shock/choke collars, retractable leashes)

  • No human food in class

  • No on-leash greetings or contact between dogs

  • Keeping at least 3 feet between dogs at all times

  • Removal from class may occur for behavior concerns or safety violations

9. Governing Law and Dispute Resolution
I agree that any dispute will be resolved via binding arbitration in Haralson County, GA, per the American Arbitration Association. The prevailing party may recover legal fees. No special or punitive damages may be awarded.

10. Entire Agreement
These Terms, along with the Dog Training Agreement and Evaluation Form (also known as the Intake Form), represent the entire agreement between the parties.
